Dartmoor Zoo Competition Terms and Conditions

The Company refers to Dartmoor Zoological Society and its subsidiary, Dartmoor Zoo Enterprises Ltd under the trading name of Dartmoor Zoological Park

The Entrant(s) refers to anyone participating in a competition published by The Company having fully met the Qualifying Criteria of said competition

Qualifying Criteria refers to the criteria detailed herein which govern eligibility for all competitions and must be met by Entrant(s)

Competition Criteria refers to the specific criteria and instructions governing eligibility for the published competition such as, but not limited to, method(s) of participation, age limitations, entry/closing dates, methods of winner selection, etc.

 

1. The following conditions apply to all competitions published by The Company and its nominated third party agents.

2. By entering a competition Entrants accept these terms and conditions together with the Competition Criteria. In the event of any inconsistency between these terms and conditions and the Competition Criteria, the Competition criteria will prevail.

3. The Company may cancel or amend these terms and conditions and Competition Criteria without prior notice. Any such changes will be posted either within the competition information, on the website www.dartmoorzoo.org

 

The following general terms and conditions apply to all competitions promoted by The Company.

4. Qualifying Criteria

4.1 Entrants must meet the following Qualifying Criteria. Failure to do so may result in an entry being declared invalid and/or forfeiture of any prize.

4.2 Where applicable, participation of persons under the age of 18 years is authorised and governed by the person’s parent or legal guardian. Such parent or legal guardian hereby accepts responsibility for meeting the requirements stipulated herein. All other Entrants must be over the age of 18 years at the time of entry.

4.3 Entrants must be residents of the United Kingdom, which comprises England, Northern Ireland, Scotland ,and Wales. For the avoidance of doubt, Jersey, Guernsey, and the Isle of Man do not form part of the United Kingdom for these purposes.

4.4 The Company reserves the right to ask competition winners for proof of UK residency. If an Entrant is unable to prove their residency to The Company’s satisfaction (i.e. prove that they are physically present in the UK for 183 days or more in the previous or current UK tax year), The Company reserves the right to select an alternative winner.

4.5 All employees and members of their immediate families (including any live-in partner) of The Company and any of their subsidiaries and/or agencies associated with this competition, including the provider of the prize, or any person/company connected with the administration or otherwise of the competition and/or prize where applicable, are ineligible to enter. Any such entries are invalid.

4.6 The Company reserves the right, in its sole discretion, to ask for evidence to verify the age, identity and/or eligibility of an entrant at any time, and to use any legitimate channels and methods available to carry out checks of any details provided. The Company may withhold delivery of the prize until it has received such evidence. The absence of such evidence may result in forfeiture of the prize. Entrants may only enter the competition in their own name.

5. Participation

5.1 The opening and closing dates and times for entries are as indicated in the Competition Criteria. Any entries received before the opening and after the closing of the competition will be declared invalid.

5.2 By participating in the competition Entrants warrant that all information submitted by them is true, accurate, current and complete. Where applicable, Entrants also warrant that they are the copyright owners of any copyright works submitted, for example photographs, videos and drawings, and The Company's use of such works will not infringe the rights of any third party.

5.3 In order to enter the competition, entrants must fully comply with the Competition Criteria. Entrants may be required to provide their full name, full contact telephone number (including area code) or other method of contact (if applicable), email address and any other information as specified. The Company will not be able to amend such information once entry to the competition has been made.

5.4 Where applicable, each Entrant will be charged the cost of entry as indicated in the Competition Criteria whether their entry to the competition is successful or not. Where applicable, Entrants must have the permission of the bill payer before entering the competition. The cost of entry and any entry delivery costs as indicated in these general terms and conditions or in the Competition Criteria includes taxes.

5.5 The Company cannot guarantee that entries made from outside the United Kingdom will be entered into the competition. If an Entrant enters the competition from outside the United Kingdom they must still meet all applicable criteria.

5.6 Any limit on the number of entries a person or household may make will be stipulated in the Competition Criteria. Should entries received exceed the limit, The Company will select one entry into the competition. Where the Competition Criteria allows multiple entries no more than one prize per person/household per competition will be awarded.

5.7 Entry to the competition may only be made through the applicable method(s) indicated in the Competition Criteria. Such methods may include Web Site, Email, Postal and Social Media. Entrants may be required to supply their name, and/or email address and/or a contact telephone number and/or any other details. Postal entries without correct and sufficient postage paid will be invalid and will not be considered. Failure to provide all the information stipulated in the Competition Criteria may result in the entry being declared invalid.

5.8 Neither The Company nor its servants, agents, nor any other party or organisation involved in the management, promotion or administration of the competition or its entry routes or donation of prizes or their agents or subsidiaries involved in the competition will accept responsibility or liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions (including but not limited to security functions by software used by The Company or any third party), virus, bugs, or other causes outside its control.

6. Restrictions

6.1 Any restriction on the number of times you may participate in the competition or other restrictions is as specified in the competition information.

7. The Prize

7.1 Details of the prize(s) will be published with the Competition Criteria. Unless otherwise stated in the therein only one prize per person will be awarded.

7.2.1 Where prizes are provided by The Company, such as, but not limited to Experience Days, Dartmoor Zoo Memberships and Admission Tickets, any additional information, conditions and restrictions applicable to the prize including but not limited to seasonal validity, availability, age and date restrictions, etc., will be published on The Company’s web site in the sections relevant to said prices.

7.2.2 Similarly, where prizes are provided by a third party, such will be subject to any additional terms, conditions and restrictions published by the third party.

7.3 All prizes are subject to availability and confirmation of acceptance by the winner. For the avoidance of doubt, The Company will make all reasonable efforts to contact the winner of the prize but should it fail to do so, will nominate an alternative winner.

7.4 The prize excludes all other costs and arrangements not expressly included in the prize such as, but not limited to, travel, accommodation, insurance, etc. Additional charges and expenses incurred for goods, services, attractions, facilities, upgrades, activities and events not expressly included in the prize are payable solely by the winner (and where applicable their companion(s)). The Company will not be held liable where such charges and/or expenses are incurred, and no refund or reimbursement will be made. DZP will accept no responsibility where the winner is unable to pay in full, any such charges and/or expenses as incurred.

7.4 No cash equivalent or alternative prize will be given and the prize is non-transferable and non-exchangeable. However, The Company reserves the right to change the prize due to circumstances beyond its control or if any part of the prize otherwise becomes unavailable, and/or to offer an alternative prize. If for any reason the winner chooses not to take up the prize or any part of the prize, The Company reserves the right to ask the winner to confirm this in writing so that it may be able to retain or dispose of the prize at its own discretion.

7.5 The Company may refuse to provide a prize, or seek its recovery, in the event of non-entitlement under the competition terms and conditions or an entrant's breach of the competition terms and conditions, fraud or dishonesty, including but not limited to the use of technology which enables an entrant to evade applicable charges when entering the competition.

8. Winner Selection and Contact

8.1 Winners will be chosen by The Company in accordance with the Competition Criteria.

9. Liability
In relation to all competitions promoted by The Company:

9.1 Nothing in the competition terms and conditions restricts your statutory rights as a consumer.

9.2 Nothing in the competition terms and conditions shall exclude or limit The Company and/or its third party representatives’ liability for death or personal injury caused by their staff or supplier's negligence or for fraud.

10. Privacy

10.1 Information and data ("personal data") which is provided by you when you enter the competition will be held and used by The Company and its third party representatives in order to administer and fulfil the competition and prize in connection with payments for entry to the competition.

10.2 In the absence of an ‘opt-out’ declaration, The Company reserves the right to use any personal data for the purposes of marketing its products and services. However, it will only pass your data to third parties for marketing purposes if you have accepted to receive marketing information from those third parties.

10.3 Any personal data will be used in accordance with The Company’s privacy policy.

10.4 The Company and/or the prize provider may be required to send personal data of the winner (and where applicable, their companion(s)) to third parties outside the United Kingdom, for the purposes of fulfilling and administering the competition and/or the prize and the competition winner agrees to such transfer for these purposes.

10.5 The winner of the competition may be required to participate in publicity. The Company (or any third party nominated by The Company) may at its sole discretion use the competition winner's (and if applicable their companion's) name and image and their comments relating to the prize and competition experience for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid.

10.6 Competition winners will be listed on The Company’s web site at www.dartmoorzoo.org.uk and its social media platforms. Hence, your name and location may be so published if you are a winner.
